Welcome to "Shadow Engage" (hereinafter referred to as "the Game"), developed by W.XZ (hereinafter referred to as "we" or "the Developer"). Before using the Game, please read and agree to the following Terms of Use carefully. These Terms of Use (hereinafter referred to as "this Agreement") constitute a legal agreement between you (hereinafter referred to as "the User") and the Developer regarding the Game.
1. Definitions
The Game: Refers to the software named "Shadow Engage" developed by the Developer, including but not limited to software code, documentation, interface designs, audio and video content, etc.
User: Refers to any individual or entity who downloads, installs, or uses the Game.
Additional Features: Refers to features or services in the Game other than the basic functions, including but not limited to top-ups, purchasing virtual items, etc.
2. Acceptance of Terms
By downloading, installing, using, or otherwise accessing the Game, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
If you do not agree to any terms of this Agreement, please do not download, install, or use the Game.
3. Subject of the Agreement
This Agreement sets forth the rights and obligations between the User and the Developer during the use of the Game, as well as the rules and norms that both parties should comply with.
4. Scope of Use and Additional Features
Scope of Use:
The Developer grants the User a personal, non-transferable, non-exclusive license to use the Game within the scope specified in this Agreement.
The User may only use the Game for non-commercial purposes such as entertainment and leisure.
Additional Features:
Users may choose to use the Additional Features provided in the Game, such as purchasing virtual items or subscription services.
Additional Features may require payment of corresponding fees; the specific charges are subject to the prices announced within the Game.
5. Obligations of the Developer
Provision of Services: The Developer shall provide the relevant services of the Game to the User in accordance with the provisions of this Agreement.
Maintenance and Updates: The Developer is obliged to maintain and update the Game to ensure its normal operation.
Information Protection: The Developer shall protect the User's personal information and comply with relevant laws, regulations, and provisions of the Privacy Policy.
6. Rights of the Developer
Modification and Termination: The Developer reserves the right to modify, suspend, or terminate part or all of the Game's services at any time as needed.
Rule-Making: The Developer has the right to formulate and modify the rules and policies related to the Game and publish them within the Game.
Punitive Measures: For Users who violate this Agreement or the Game rules, the Developer has the right to take measures such as warnings, restricting functions, or banning accounts.
7. Limitation of Developer's Liability
Service Status: The Game is provided "as is," and the Developer makes no express or implied warranties regarding its applicability, error-free operation, or continuity.
Indirect Losses: The Developer shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Game.
Force Majeure: The Developer shall not be liable for service interruptions or other defects caused by force majeure or other uncontrollable reasons.
8. Refund Policy
Refund Conditions: Except as otherwise provided by laws and regulations, fees already paid (such as for purchased virtual items or subscription services) are non-refundable.
Special Circumstances: If the User suffers losses due to technical faults, account theft, or other reasons, the User may contact the Developer's customer service, and the Developer will handle the situation as appropriate.
9. Obligations of the User
Lawful Use: Users shall comply with laws, regulations, and the provisions of this Agreement and shall not use the Game for any illegal or improper activities.
Account Security: Users are responsible for safeguarding their account information and shall not share their account or password with others.
Compliance with Rules: Users shall comply with the rules and policies of the Game and shall not engage in behaviors such as cheating or interfering with the game order by exploiting game bugs or third-party software.
10. Additional Features of the Game
Virtual Items: The Game may provide virtual currencies, props, and other virtual items. Users only obtain the right to use them, and ownership belongs to the Developer.
Validity Period: Some virtual items may have a validity period. Users should use them within the valid period, and expired items will not be compensated.
11. Compensation for Technical Issues
Fault Handling: If the User cannot use the Game normally due to technical problems, the Developer will repair the fault as soon as possible.
Compensation Measures: For reasonable losses caused to the User due to technical faults, the Developer will compensate by issuing virtual items or virtual currencies within the Game. Compensation in legal tender is not available.
12. Dispute Resolution
Amicable Negotiation: Any disputes arising from or related to this Agreement shall first be resolved through amicable negotiation between the parties.
Jurisdiction: If negotiation fails, both parties agree to submit the dispute to the court with jurisdiction in the Developer's location.
13. Other Provisions
Entire Agreement: This Agreement constitutes the entire agreement between the parties regarding the subject matter and supersedes any prior oral or written agreements.
Severability: If any provision of this Agreement is deemed invalid or unenforceable, that provision shall be severable and shall not affect the validity and enforceability of the remaining provisions.
Notices: The Developer may send notices to Users through in-game announcements, emails, or other reasonable means.
